1. Introduction

Welcome to Fuze Store, operated by Fuze-Store IT Solutions (“Company,” “we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your access to and use of the Fuze Store point-of-sale (POS) and store management platform, including its web, mobile, and related services (collectively, the “Service”).

By creating an account or using our Service, you agree to these Terms. If you do not agree, please do not use the Service.

2. Account Terms

• You must be at least 18 years old or the age of legal majority in your jurisdiction to use the Service.
• You are responsible for maintaining the confidentiality of your account credentials and all activity under your account.
• Each store account may create and manage staff accounts with assigned permissions. The store owner retains ownership and control over all related staff accounts.
• You agree to provide accurate, current, and complete information during registration and keep it up to date.
• We reserve the right to suspend or terminate any account that violates these Terms or applicable laws.

3. Subscription and Billing

• Fuze Store operates on a subscription basis with automatic renewal.
• Subscription fees are billed monthly via our payment processor Adyen.
• A 30-day free trial is provided for eligible users.
• All payments are non-refundable, including partial months or unused periods.
• Subscriptions automatically renew unless canceled before the next billing cycle.
• You may upgrade, downgrade, or cancel your plan at any time through your account settings. Downgrades may take effect at the next billing cycle.
• Taxes, transaction fees, and currency conversion may apply based on your region.

4. Use of the Service

You agree not to:

• Copy, modify, reverse engineer, or distribute any part of the Service.
• Use the Service for any unlawful, fraudulent, or abusive activity.
• Interfere with the operation or security of the Service.
• Resell, sublicense, or provide unauthorized access to others.

Fuze Store is intended for legitimate business operations. You are solely responsible for complying with local laws and tax regulations applicable to your business.

5. Data Ownership and Content

• Store owners retain full ownership of the data created or uploaded through the Service (including orders, products, and customer information).
• By using the Service, you grant Fuze Store a limited license to host, process, and back up data as needed to operate and improve the platform.
• We do not claim ownership of your business data.
• You are responsible for ensuring that all submitted content complies with applicable laws.

6. Service Availability

We aim to maintain continuous uptime but cannot guarantee uninterrupted service. Maintenance, updates, or unforeseen issues may cause temporary downtime.
Fuze Store is not liable for any loss of data, revenue, or business interruption resulting from downtime.

7. Termination

You may terminate your account at any time. Upon termination:

• Access to the Service will cease.
• Data may remain available for export for up to 30 days, after which it may be permanently deleted.
  We may terminate or suspend access for violations of these Terms or suspected misuse.

8. Limitation of Liability

To the maximum extent permitted by law:

• Fuze Store and its affiliates shall not be liable for indirect, incidental, or consequential damages, loss of profits, or loss of data arising from your use of the Service.
• The Service is provided “as is” and “as available.”
• Our total liability in any claim shall not exceed the total subscription fees paid in the last three months.

9. Governing Law

These Terms shall be governed by and construed in accordance with neutral international principles, with primary dispute resolution under arbitration in Singapore, unless otherwise required by local law.

10. Modifications

We may update or modify these Terms at any time. Updates take effect upon posting. Users will be notified via email or in-app notice when changes are significant.
